PolkaGrid is operated by Davinchi Limited, a company registered in New Zealand, trading as PolkaGrid ("PolkaGrid", "we", "us"). You can contact us at hello@polkagrid.com.
These Terms of Use ("Terms") apply to your purchase and use of the PolkaGrid service and the documents it produces. By ticking the acceptance box at checkout and completing a purchase, you agree to these Terms.
PolkaGrid generates AI usage policy documents based on the information you provide through our questionnaire. The documents are professionally prepared templates intended as a starting framework for your organisation.
The documents are general in nature. They are not tailored legal advice and may not address the specific circumstances, obligations, or risk profile of your organisation.
No solicitor-client relationship is created between you and PolkaGrid, Davinchi Limited, or any person associated with them by your use of the service or receipt of the documents.
We recommend you have the documents reviewed by a qualified professional and adapted to your circumstances before you adopt them.
We retain ownership of the PolkaGrid service, its templates, and its underlying content. On payment, we grant you a non-exclusive, perpetual licence to use, adapt, and internally distribute the documents you receive for the purposes of your own organisation.
You may not resell, sublicense, publish, or redistribute the documents or templates as a standalone product, or use them to develop a competing service.
Prices are shown at checkout in New Zealand dollars. We are not registered for GST, so no GST is charged on your purchase. Payment is processed by Stripe, and your use of that payment process is subject to Stripe's own terms.
Purchases are one-time. We do not charge you on a recurring basis, and nothing renews automatically.
Documents are delivered electronically by email to the address you provide at checkout, following successful payment. Documents are supplied as editable Microsoft Word (.docx) files. You can also print or save a copy from your browser once your policy is unlocked.
If your documents do not arrive, contact us at hello@polkagrid.com and we will re-send them.
Because the documents are digital goods delivered immediately on payment, we do not offer refunds once the documents have been delivered, except where required by law. Nothing in this clause limits your rights under the Consumer Guarantees Act 1993 or the Australian Consumer Law where those apply.
The documents are provided as a starting framework, on an "as is" basis. To the extent permitted by law, we do not warrant that the documents are fit for any particular purpose, or that adopting them will achieve or maintain compliance with any particular law, standard, or obligation in your specific circumstances.
Where you acquire the service in trade, the Consumer Guarantees Act 1993 does not apply and is expressly excluded.
Nothing in these Terms excludes, restricts, or modifies any guarantee, right, or remedy that cannot lawfully be excluded, restricted, or modified.
To the maximum extent permitted by law, our total aggregate liability arising out of or in connection with the service and the documents, whether in contract, tort (including negligence), equity, or otherwise, is limited to the amount you paid for the relevant purchase.
We are not liable for any indirect, consequential, or special loss, or for loss of profits, revenue, data, goodwill, or business opportunity.
Nothing in this clause limits liability that cannot be limited under applicable law.
Our handling of personal information is described in our Privacy Policy.
We may decline to provide the service, or revoke a licence granted under clause 4, where you breach these Terms or misuse the service.
We may update these Terms from time to time. The version in force at the time of your purchase governs that purchase.
These Terms are governed by the laws of New Zealand, and you submit to the non-exclusive jurisdiction of the New Zealand courts.
